You the customer and ClairHair are in agreement that all terms and conditions are exclusive terms governing any sales transaction between ClairHair and the customer. Any attempt to change, alter, modify, or amend any of these terms and/or conditions by the customer will be considered a material alteration of this agreement and, therefore, rendering null and void. We do reserve the right to change these terms and conditions at any time, without written or verbal notice. ClairHair passes any, through to all customer(s) warranties given by the manufacturer; by purchasing from ClairHair the customer acknowledges that this shall have recourse only under such warranties and only against the manufacturer of the product. ClairHair.com makes No representation with respect to the product and the manufacturers. ClairHair.com disclaims all other warranties implied or otherwise, as to any such product, including and without limitation, the implied warranties of merchantability, fitness for a particular purpose or instance, and any implied warranties arising from statute, trade usage, course of dealing, or course of performance.  
 
 
 
Price Matching 
 
 Clairhair.com will price match providing certain criteria has been met. If the item listed on a competitor’s website(s) in the same brand, length and color is in-stock. The competitor is not EBay. They competitor is of reputable standing with corporate and/or public offices. The competitor is not and individual, the competitor is a licensed practicing business professional.  
 
 
 
Bulk Order 
 
 Clairhair.com is not a wholesaler. Clairhair.com does offer special rates, providing that the product total of any given order exceeds a pre-determined dollar amount that Clairhair.com has set, Clairhair.com reserves the right to adjust these rates at their discretion.  
 
Rates  
 1. For any order that the product amount is greater than $500 you will receive 15% discount 
 
 2. For any order that the product amount is greater than $1000 you will receive 20% 
 
 
 
Sales Tax 
 
 Sales tax is only required for orders shipping into states that Clairhair.com has nexus for state tax purposes under applicable law(s). Therefore all orders shipping to Illinois will be charged applicable sales tax according to Illinois’s tax rate.  
 
 
 
Risk of Loss 
 
 Clairhair.com will arrange for shipment of ordered product(s) to the Customer. The risk of loss passes to the Customer upon delivery to and from the carrier. Clairhair.com will advise Customer of estimated shipping dates, but Clairhair.com will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes. Clairhair.com can not be held for any damages received for late arrival loss or stolen packages. Clairhair.com, under no circumstance can be held responsible for orders that have been shipped to an alternate location specified by the customer with or without intent, providing the product was purchased online at Clairhair.com.  
 
 
 
Governing Law and Jurisdiction 
 
 Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Clairhair.com and Customer shall be governed by the laws of the State of Illinois, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Clairhair.com and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Illinois, Cook County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Clairhair.com that is more than six months after the date of the applicable invoice.  
 
 
 
Severability 
 
 If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Illinois law.
